It is informed that the contract will only be accepted and legally valid for Users with the legal capacity to exercise.

Eugénio Campos Diamonds is committed to ensuring that the products sold on the website are available, allowing the customer to obtain this information. In case of stock shortages and the inability to fulfill or ship an order immediately, the customer will be promptly informed.

The prices displayed represent the unit price, which includes all applicable taxes. Postal deliveries and accessories may incur an additional charge, which will be the responsibility of the customer, and this amount will be shown before the completion of the purchase.

 

Purchase Process

After registration or entering the data, the User can proceed with the purchase process by adding the desired items to the virtual shopping cart. In the virtual shopping cart, the User always has the option to modify the quantity of the desired items (add or remove).

Payment and Billing Process

Eugénio Campos Diamonds offers various payment methods, including credit card, MB Way, Multibanco references, PayPal, Klarna, and soon, Apple Pay and Google Pay.

Payment processes are mediated by Easypay - Instituição de Pagamento Lda, PayPal, and Klarna on behalf of Eugénio Campos Diamonds.

Eugénio Campos Diamonds is committed to protecting the confidentiality of its customers' payment data. All financial data provided during the payment process is transmitted via a secure, encrypted connection using SSL (Secure Sockets Layer) technology. Furthermore, payment details are processed exclusively by secure and certified payment platforms, ensuring that no sensitive information is stored on our servers.

To prevent fraud in transactions and payments made through the website, Eugénio Campos Diamonds adopts advanced and preventive mechanisms that analyze characteristics of purchases that may appear fraudulent.

Regarding payments via credit card, the purchase will only be completed once the credit is verified. If the transaction is rejected by the bank, the purchase will be automatically canceled.

If the charged amount results from a fraudulent transaction or misuse of the customer’s card number by third parties, the customer may request the immediate cancellation of the charge through our contact page. Once it is verified that the purchase was fraudulent, Eugénio Campos Diamonds will refund the corresponding amount.

If it is found that the allegedly fraudulent transaction was indeed initiated by the customer, and the customer requests the cancellation, they must compensate Eugénio Campos Diamonds for any resulting damages from the cancellation.

The invoice issued will include the information provided by the customer, the breakdown of the prices of the purchased items, the shipping cost, and applicable VAT. In no case will the information on the invoice be altered.

In the event that the user does not make (valid and irrefutable) payment within 24 hours, Eugénio Campos Diamonds reserves the right to cancel the order.

Order Confirmation

The purchase will be completed once the User clicks on the "Pay and Complete Purchase" button and will be confirmed by an email sent by Eugénio Campos Diamonds within 24 hours, thereby formalizing the purchase and sale contract for the items purchased.

The confirmation email will include the order number, which the User must reference in any communication they wish to have with Eugénio Campos Diamonds. The order number is mandatory for indicating any changes or discrepancies in the order. Any charges resulting from discrepancies not reported in a timely manner will be exclusively borne by the User.

If one or more of the items ordered by the User are unavailable, Eugénio Campos Diamonds will notify the customer regarding the unavailability of the respective items.

 

Shipping and Delivery

The User, when placing their order, can take advantage of the following options:

 

The delivery time for items is usually 24 to 48 hours, but it may be delayed due to logistical issues, carrier delays, or stock shortages.

All shipments and order dispatches are made to mainland Portugal, the Madeira Archipelago, the Azores Archipelago, and the European Union. P.O. Boxes are not accepted as delivery addresses.

Upon delivery by the carrier, they must provide a receipt to be signed by the User or by the person who is authorized to receive the order. It is presumed, for all purposes, that any person at the delivery address provided by the User has the authority to receive the order. It is the User's responsibility to ensure that a person is present at the address to receive the order.

Shipping costs on the website www.eugeniocamposdiamonds.com are the responsibility of Eugénio Campos Diamonds.

Finally, Eugénio Campos Diamonds uses CTT, DPD, and DHL as carriers, all of which are express service providers.

 

Campaigns, Promotions and Offers

Eugénio Campos Diamonds reserves the right to organize its campaigns, promotions, and offers (hereinafter referred to as Campaigns) based on the destination country to which they are strategically directed.

The Campaigns are subject to the conditions indicated for each individual promotion, as well as these Terms and Conditions of sale. The User acknowledges that in the event of a conflict, the rules applicable to the specific conditions of the ongoing Campaign will prevail.

If a Campaign aims to offer a good or product and the User exercises their right of cancellation or return of the purchased product, this act also implies the return of the offered product.

The offers received cannot be sold or transferred to third parties by the User with the intention of obtaining, directly or indirectly, an economic profit.

The User may waive the free offer, but cannot request or obtain any compensation for such a waiver.

During the various Campaigns, the enjoyment of the offer is only considered valid after the effective payment of the order within a maximum period of 24 hours. Additionally, it is informed that during the Campaigns, deliveries may experience delays.

Purchases of items in a Campaign are valid upon their presentation in the online store and can be consulted in the Frequently Asked Questions section. All campaigns are subject to stock limits and the conditions may be altered at the discretion of Eugénio Campos Diamonds. In case of spelling errors, prices, stock issues, or other data discrepancies, Eugénio Campos Diamonds reserves the right to cancel the User's order.

Finally, Eugénio Campos Diamonds reserves the right to cancel any unpaid orders up to 24 hours after the order registration or due to stock unavailability.

 

Exchanges, Returns and Cancellations

The customer, when purchasing items from Eugénio Campos Diamonds through the Website, has the right to freely resolve the contract under the terms of Article 11 of Decree-Law 24/2014, of February 14.

We are dedicated to providing excellent service to our customers. As part of this commitment, we offer a service that allows for the return or exchange of items for others of equal or higher value within a reflection period of up to 30 days, both counting from the date of purchase.

From November 20 to December 14, exchanges can be made until January 14 of the following year. Gift bags are non-refundable.

To exchange or return items, please follow these steps:

  1. If you made the purchase as a guest: create an account with the email associated with the order you wish to exchange or return;
  2. Log in to your customer area and select the order corresponding to the item you wish to exchange/return;
  3. Click on Exchange/Return and select the item;
  4. Fill in the required fields regarding the exchange or return request;
  5. If you are in mainland Portugal, we will contact you to schedule the collection of your order;

Upon arrival, the Eugénio Campos Diamonds team will perform a quality control process of the item(s), validating the eligibility for the exchange or return.

Once the exchange or return is accepted, the following rules apply:

  • Exchange of items: Eugénio Campos will issue a credit note for the original order and send the new items with a new invoice. The value of the exchange must be equal to or greater than the original purchase.

  • Return of items: To process the return of the purchase amount, Eugénio Campos will refund the amount through the same payment method used by the consumer in the initial transaction, unless otherwise agreed upon, and provided the consumer does not incur any costs as a result of the refund. Refunds will only be processed after receiving the returned items. Gift bags are non-refundable.

  • Cancellation: Once the purchase is canceled, Eugénio Campos Diamonds will refund the amount through the same payment method used by the consumer in the initial transaction, unless otherwise agreed upon, and provided the consumer does not incur any costs as a result of the refund. Returned products must be in sellable condition, meaning in the same state as when they were received by the consumer, without any defects or damage. Refunds will only be made after receiving the returned items. Eugénio Campos is committed to refunding the consumer within a maximum of 10 days.

Special Considerations:

  • Regarding personalized and custom-made items, Eugénio Campos Diamonds does not accept any exchanges or returns due to their specificity.

  • In the process of sending one or more items for exchange or return, the customer (user or buyer) is responsible for the proper use, security, and correct shipping of the items to the Eugénio Campos address. Therefore, we are not responsible for any damage or loss resulting from this shipping process.

If you receive an incorrect item or one with a defect, please contact our team directly by accessing the contact details. This way, we can prioritize and give special attention to the return and refund or exchange process.

 

After-Sales Service

The items sold by Eugénio Campos Diamonds are covered by a 3-year manufacturer's warranty. After the warranty period, Eugénio Campos Diamonds provides technical assistance. Items with defects or malfunctions should be reported using the options available on the contact page. If the repair incurs costs for the User, they will be informed in advance, and the repair will only proceed once the User has given approval.

 

Item Warranty

During the warranty period, any item that presents a manufacturing defect will be repaired free of charge or replaced with a similar model.

In cases where the item cannot be repaired, the User must present the non-conforming item, along with the original warranty certificate, duly and fully completed (indicating the purchase date, name, address, and the reference assigned to the item – when applicable – or product designation), as well as the purchase invoice or another valid proof of purchase.

Warranty exclusions include materials subjected to breakage, loss, theft, deterioration, oxidation, defects caused by impact, including deformations originating from daily and/or improper use, inadequate maintenance and cleaning, negligence, improper handling, modifications to the original product, and repairs not authorized by the brand.

 

The warranty conditions are governed by Decree-Law No. 84/2021, of October 18, which regulates consumer rights in the purchase of goods, under Directives (EU) 2019/771 and (EU) 2019/770, of May 20. Among other rules, the legislation establishes:

  1. Consumer rights in case of non-conformity (such as defects) of movable goods and others;
  2. Extension of the warranty period for goods from 2 to 3 years, with the consumer needing to prove that the defect existed at the time of delivery during the third year;
  3. An additional six-month period if the consumer opts for the repair of the item (up to a maximum of 4 repairs);
  4. The "right of rejection," which allows the consumer to freely choose between the replacement of the item and the termination of the contract when non-conformity appears within the first 30 days from the delivery date.

Pricing Policy

Eugénio Campos Diamonds reserves the right to change the prices and/or characteristics of items and services without prior notice. All prices presented include VAT at the applicable legal rate.

 

Complaints and Dispute Resolution

If any dispute or disagreement arises related to the use of our Website or the making of purchases, we recommend that you contact us directly through the contact methods available on the contact page . We will try to resolve any issues promptly.


However, if an agreement cannot be reached, any dispute will be submitted to the competent court of the Vila Nova de Gaia district, in accordance with Portuguese legislation.
